1. Acceptance of Terms

By downloading, installing, or using First Pick ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App.

2. Description of Service

First Pick is a photo organization app that helps you identify similar and duplicate photos in your library. The App processes your photos entirely on your device and does not upload or transmit your photos to any external servers.

The App uses third-party services for subscription management (RevenueCat) and analytics (PostHog), which are subject to their respective terms of service and privacy policies.

3. Eligibility

You must be at least 13 years old to use First Pick. By using the App, you represent and warrant that you meet this age requirement.

4. Subscriptions and Payments

First Pick offers subscription-based access to premium features. Subscriptions are managed through Apple's App Store and are subject to Apple's terms and conditions.

• Free trial: New users may be eligible for a 7-day free trial
• Billing: Subscriptions are billed weekly at the rate displayed in the App Store
• Cancellation: You may cancel your subscription at any time through your Apple ID settings
• Refunds: Refund requests are handled by Apple according to their refund policy

5. User Responsibilities

You agree to:

• Use the App only for lawful purposes
• Not attempt to reverse engineer or modify the App
• Review photos carefully before deletion, as deleted photos may not be recoverable
• Maintain backups of important photos before using bulk delete features

6. Limitation of Liability

The App is provided "as is" without warranties of any kind. We are not liable for any damages arising from your use of the App, including but not limited to:

• Loss of photos or data
• Accidental deletion of photos
• App malfunctions or errors
• Incompatibility with your device

Always maintain backups of your photos. We strongly recommend enabling iCloud Photos or using another backup solution before using bulk delete features.

7. Intellectual Property

The App and its original content, features, and functionality are owned by New Way Labs and are protected by international copyright, trademark, and other intellectual property laws.

8. Termination

We reserve the right to terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

9. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of significant changes through the App. Continued use of the App after changes constitutes acceptance of the new terms.

10. Governing Law

These terms are governed by and construed in accordance with the laws of the United Kingdom.
